They said that the basic tenets of our legal system have not changed, but given Canada's attitude towards the death penalty in the time between Kindler and this case, the tilt of extradition without assurances in Kindler being considered constitutional, has now tilted on the other side and is now unconstitutional under s.7 of the charter, therefore the Ministers appeal was dismissed.
