The Swampbuster provision requires the withholding of all USDA program benefits from any person who 1) plants an agricultural commodity on a wetland that was converted after December 23, 1985, or 2) converts a wetland for agricultural commodity production after November 28, 1990, even if the crop is not planted (USEPA 1991a). Benefits that can be lost under the Swampbuster provision include commodity supports, crop insurance, and disaster payments.
